近一段时间以来,AMSA 在进行 PSC 检查时,发现部分船公司在船员就业协议(Seafares’Employment Agreement, 简称
SEA)到期后没有及时组织更换船员,而是对现有 SEA 进行了展期或者重新签署一份 SEA,违背了《2006 海事劳工公约》的规定。AMSA
因此而给出了缺陷。
注意到《2006 海事劳工公约》的下列条款:
标准 A.2.5.2(b)-- 海员在有权得到遣返前在船上服务的最长期间——这段时间应少于 12 个月。(The maximum duration of
service periods on board following which a seafarer is entitled to repatriation
– such periods to be less than 12 months)。
AMSA 对 上 述 “ 标 准 A.2.5.2(b) ”的解释:This doesn’t necessarily mean they MUST be
repatriated, but rather they are ENTITLED to repariation。也就是说,《2006 海事劳工公约》“标准
A.2.5.2(b)”强调了船员应该享受的遣返权利。
同时,我们还注意到《2006 海事劳工公约》的下列条款:
标准 A.2.4.2— ……船员带薪年休假的权利应以每服务两个月最低 2.5天计算……(……the annual leave with pay
entitlement shall be calculated on the basis of a minimum of 2.5 calendar days
per month of employment……)
所以,对于一个日历年,船员可以累积到 30 天的带薪年休假。
标准 A.2.4.3—除非属于主管当局规定的情况,否则禁止达成放弃享受最低带薪年休假的任何协议(Any agreement to forgo the
minimum annual leave with pay prescribed in this Standard, except in cases
provided for by the competent authority, shall be prohibited.)
通过国际劳工组织(ILO)的官方网站,我们还可以了解到以下关于船员在船工作时间的进一步解释。即:船员在船的最长工作时间为 11 个月。

C2.4.c. Does this mean that the maximum period that a seafarer can serve on
board a ship is 11 months before taking one month of paid annual leave?
Yes. The concept of paid annual leave implies that it is to be taken annually
and therefore the maximum period for service on board a ship without leave would
be 11 months. This is also linked to the requirement in Standard A2.5, paragraph
2(b), regarding the entitlement to repatriation in a period of less than 12
months .
